Shop wins fight for canopy plan

The proposals from Karan Nayyar came in part to address enforcement action initiated by Southampton City Council over an existing wooden canopy that had gone up without planning permission.

The scheme at 298 Burgess Road, which is located at the corner with Langhorn Road in Swaythling, went before members of the planning and rights of way panel.

This was after the application received six representations from surrounding residents who objected to the development.

The panel heard the scheme featured an open-sided steel canopy to the front and sides of the retail unit.

It also included installing a brick wall along the boundary to Langhorn Road and replacement fences to improve the external yard area.

The yard will be home to free-standing storage and chiller units, and a toilet.

Planning agent Jayanand Kumaraguru, speaking on behalf of the applicant, told the meeting on Tuesday, September 2, the shop area was quite small and the proposal was looking to address this.

Swaythling ward councillor Lorna Fielker said she was pleased to see amendments had been made to the application since it had been submitted, with these measures resolving a lot of the issues raised.

She said her main concern was the use of a hatch to serve customers from the street late at night.

The panel heard that a premises licence, which was granted earlier this year, conditioned the hatch could be used between 11pm and midnight on Friday and Saturday.

Environmental health officers had not objected to the planning application and suggested that the opening hours be conditioned in line with the licence.

Councillors decided to amend a proposed planning condition around the external produce displays under the canopy.

Officers had put forward a requirement for these displays to be removed after 7pm, but the panel voted to change this to 9pm.

They subsequently approved the planning application, with one councillor voting against.
